HOW TO ENTER THE COMPETITION

To automatically receive an entry, individuals must, during the promotional period, make a donation of $50 or more to Education for Ecuador. Entrants will automatically receive one entry into the prize draw for an LCD television set for every separate donation (non tax-deductible) when they log onto http://www.educationforecuador.org/get-involved.shtml and follow the prompts as to donate, input the requested details and submit the fully completed entry form during the promotional period to make a donation.

TERMS AND CONDITIONS

1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2. Entry is only open to Australian residents who make a qualifying donation during the promotional period from 29th August 2008 until 7th November 2009.

3. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

4. Incomplete, indecipherable or illegible entries will be deemed invalid. Anonymous donations will not be eligible to receive an entry.

5. Multiple entries permitted, subject to the following: (a) only one entry permitted per qualifying donation; and (b) each entry must be submitted separately and in accordance with entry requirements.

6. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

7. Promotion commences 9am AEST on 22/08.2008 Entries via the website close 5pm AEST on 07/11/2009. The draw will take place at the Education for Ecuador Trivia Night on 07/11/2009 at St. Ignatius Church Hall, Church St. Richmond at or around 10PM. AEST.

8. Winner will be notified by mail and their name will be published in The Herald Sun on 10/11/09.

9. The Promoter’s decision is final and no correspondence will be entered into.

10. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion, subject to any written directions from a relevant regulatory authority.

11. If the winner of any prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian.

12. The prize is an LCD Television Set. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

13. The prize is not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.

14. In the event that the Promoter has not been able to contact the original drawn Participant by 12/12/09, a further draw may be conducted on that date at the same time and place as the original draw in order to award the prize. Winner’s name will be published in The Herald Sun on 19/12/09.

15. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting the charity and its Trust Fund.

16. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from the Victorian Commission for Gambling Regulation, to modify, suspend, terminate or cancel the promotion, as appropriate.

17. Liability for any tax (other than FBT) arising out of participation in this promotion (including acceptance of a prize) is the sole responsibility of the entrant. Entrants should seek independent financial advice in this regard.

18. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) participation in the Game; or (f) use of a prize.

19. As a condition of accepting any prize, the winner (and any companion/s, if applicable) must sign any legal documentation as and in the form required by the Promoter, prize suppliers and promotion organisers in their absolute discretion, including but not limited to a legal release and indemnity form.

20. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
